User Agreement

 1. Introduction: 

This User Agreement ("Agreement") delineates the legally binding terms for users accessing and utilising the "Reapsy" mobile application and website, collectively referred to as the "Platform." Operated by Hunter App Co, users are obligated to comply with the terms detailed in this Agreement.

 2. Eligibility: 

By accessing the Reapsy Platform, users affirm and guarantee that they are at least 16 years old, a prerequisite for engaging with the Platform.

 3. Platform Access: 

Access to the Reapsy Platform requires a compatible mobile device and internet connectivity. Hunter App Co retains the right to modify or withdraw Platform elements, ensuring transparency and adherence to legal principles.

 4. Use Restrictions: 

Users are expressly prohibited from misusing the Reapsy Platform. The platform is exclusively intended for the trading of home and farm produce and related products. Listings for tools, machinery, or live animals are not permitted. 

Any content violating these guidelines will be subject to removal. Users are encouraged to familiarise themselves with these restrictions to ensure a seamless and compliant experience.
 5. Your Listings: 

Users assume responsibility for aligning their listings with Reapsy Policies. The Platform reserves the right to remove content deemed inappropriate at its discretion.

 6. Fees and Payments: 

Transactions on the platform do not incur any fees. Users may pay subscription fees outlined in the app's accounts section.

 7. Reviews: 

User feedback, integral to trust and safety, may be publicly displayed on the Reapsy Platform in compliance with applicable laws. To maintain a positive and respectful environment, reviews must not contain abusive, harsh, or rude content. Any reviews violating this guideline will be promptly removed to uphold the platform's integrity.

 8. Disclaimers: 

Reapsy operates as a facilitator for transactions and does not observe or guarantee the pricing, quality, delivery, safety of interactions, or communication between users. We disclaim any responsibility for returns, refunds, or any other liabilities associated with the platform before, during, and after the listing and purchase processes. Users are urged to exercise due diligence and prudence in their engagements on the platform.

 9. Limitation of Liability: 

Hunter App Co disclaims any liability for damages arising from the use of the Reapsy Platform, covering direct, indirect, special, and consequential forms.

 10. Governing Law: 

This Agreement is governed by the laws of Australia, with users submitting to the exclusive jurisdiction of the Australian legal system for matters related to this Agreement and the Reapsy Platform.

Privacy Policy

This Privacy Policy ("Policy") outlines the practices and procedures employed by Hunter App Co, the operator of the "Reapsy" mobile application and website (collectively referred to as the "Platform"), to handle and protect the personal information of users. This Policy is in adherence to the Australian Privacy Principles (APPs) as outlined in the Privacy Act 1988 (Cth).

Reapsy may collect personal information from users during the registration process, including but not limited to names, contact details, and age verification. Users may also provide additional information voluntarily as part of their profile or listings.

Personal information is collected for the primary purpose of facilitating the use of the Reapsy Platform, ensuring compliance with eligibility criteria, and providing a personalized and secure user experience. This information may be used for transactional purposes, communication, and to enhance the overall functionality of the Platform.

 3. Use and Disclosure: 

Reapsy may disclose personal information to facilitate transactions, verify user eligibility, and maintain the integrity of the Platform. Personal information may be shared with relevant third parties for the purpose of processing transactions, provided such third parties adhere to privacy standards compatible with this Policy.

 4. Security: 

Hunter App Co employs reasonable security measures to protect the personal information stored on the Reapsy Platform. These measures include encryption, access controls, and regular security audits. However, users are advised that no method of data transmission over the internet or electronic storage is entirely secure.

 5. Access and Correction: 

Users have the right to access and correct their personal information held by Reapsy. Requests for access or corrections should be directed to the Platform's designated privacy contact.

 6. Cookies and Analytics: 

Reapsy may use cookies and analytics tools to collect information about user interactions with the Platform. This information is used to enhance user experience, analyze usage patterns, and improve the overall functionality of the Platform.

 7. Third-Party Links: 

The Reapsy Platform may contain links to third-party websites or applications. Users are advised to review the privacy policies of these third parties, as Reapsy is not responsible for the privacy practices or content of external sites.

 8. Amendments to Policy: 

Hunter App Co reserves the right to amend this Privacy Policy to reflect changes in legal requirements or the operational needs of the Reapsy Platform. Users will be notified of any significant changes to this Policy.

 10. Media Usage: 

By uploading photos and videos to the Reapsy Platform, users grant Hunter App Co an indefinite, irrevocable, and royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such media (in whole or part) worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed. This licence includes the right to sublicense, allowing Hunter App Co to grant sublicenses to third parties.

Users acknowledge that this licence allows Hunter App Co to use uploaded media for promotional, marketing, and advertising purposes, both online and offline. This includes but is not limited to the display of user-generated content on the Reapsy Platform, social media channels, marketing materials, and third-party platforms.

Users affirm that they have the necessary permissions and rights to grant this license for any media uploaded to the Reapsy Platform and that such use by Hunter App Co will not infringe on the rights of any third party.

Should users wish to revoke this licence for specific media, they must notify Hunter App Co in writing. Revocation will apply only to future use and does not affect any prior uses for which Hunter App Co obtained valid rights.

This amendment is effective upon its inclusion in the Privacy Policy and applies to all media uploaded to the Reapsy Platform thereafter. Users are encouraged to review this section regularly for any updates or changes related to media usage.

 11. Prohibition of Personal and Sensitive Information Upload: 

Users are expressly prohibited from uploading any personal and sensitive information on the Reapsy Platform. Personal and sensitive information includes but is not limited to names, contact details, financial information, identification documents, and any data that could compromise the user's privacy or security.

Hunter App Co disclaims any responsibility for the consequences arising from the upload of personal and sensitive information by users. Users are urged to exercise caution and refrain from including any such information in their profiles, listings, or any other content shared on the Reapsy Platform.

Any user found in violation of this prohibition will be subject to appropriate action, including content removal and, in severe cases, suspension or termination of their Reapsy account.

This amendment is effective upon its inclusion in the Privacy Policy, and users are encouraged to review this section regularly for any updates or changes related to the prohibition of personal and sensitive information upload.
